General terms and conditions

Our training courses are for business professionals who are using our services as part of the work undertaken by their employer or for their professional development. We can’t offer training services to consumers and as a result our training services are not covered under the Consumer Protection (Distance Selling) Regulations.

We will ask you to clarify that your are purchasing training for business purposes . If it is not clear from the registration details you provide we will not accept your order.

Booking an event

On the event page, click on the "Book now" button. You will then be asked to complete the attendees' details (including their email addresses). Click "Add to cart" to add your order to the shopping cart. You can then either continue shopping or go to the shopping cart to complete your order. The shopping cart gives you a summary of your order. Discounts, when applicable, are automatically applied at shopping cart level, except for early bird discounts and other specific discounts for which the discount code must be entered manually.

Our website lets you request an invoice or pay by credit card (see payment section below). Until payment is received places cannot be confirmed and in accordance with the first paragraph of these terms we reserve the right to reject your order if we are not content that this is a transaction made for business purposes.

By placing an order you are deemed to have accepted these terms and conditions on behalf of your company or organisation or personally if you are a sole trader.

Payment

Credit card security

Secure on-line payments are made directly through WorldPay (a Royal Bank of Scotland company). To enable WorldPay to provide secure payment facilities you will be required to supply your name, your credit or debit card number (with the expiry date) your e-mail and billing addresses. Transmission of sensitive information (such as a credit card number) over the internet is protected through the use of encryption, such as the Secure Socket Layer (SSL) protocol. HR Wallingford does not have access to your financial details. Due to procedures that exist regarding the use of credit card information, HR Wallingford will not accept any credit/debit card details sent by email, by fax or over the phone.

Alternative payment

As an alternative to paying online, you may request an invoice and pay by cheque made payable to HR Wallingford Ltd. or bank transfer (BACS payment). Official orders can be sent by post or email.

Registration fee (deposit)

When your order is accepted by us you will be required to pay the registration fee detailed on our website (plus VAT). We will invoice you and you are required to settle the invoice in full no less than 7 days prior to the date of the event. If you fail to do so we cannot guarantee your place at the event. The fee will be deemed to be a deposit until such time as you attend the event and may be retained in all or part by us if you cancel your place at the event or the event itself (dependent upon the basis of purchase). The cancellation details are below.

Tax charges

Classroom-based courses

All registration fees include applicable tax at the prevailing rate (currently 20%)/ Value Added Tax (“VAT”)must be paid on all bookings, even where the attendee(s) is/are based outside the UK.

Online courses

Registrations fees for courses booked by UK businesses will include the applicable tax at the prevailing rate (currently 20%). Registrations fees for businesses outside the UK will not be charged VAT.

Rescheduling and cancellation of events

Unless otherwise stated in the event details, our standard cancellation policy will be as follows:

If you cancel your booking:

  • over four weeks before the start of an event, your registration fee will be refunded in full, less a 10% (plus VAT) charge to cover administrative costs.
  • between two and four weeks before the start of an event, you will be refunded 50% of your registration fee.
  • less than two weeks before the start of an event, your registration fee will not be refunded.

Name substitutions will be accepted at any time but you must notify us of these in writing in advance of the event.

Classroom-based training

We reserve the right to cancel or reschedule bookings for classroom based training such as courses or workshops, at our discretion, but will endeavour to inform you as soon as possible in any such instance. If we cancel we will normally offer you an alternative date. If this date is not convenient or we are not able to offer an alternative, a full refund of the fee you have paid will be given to you . Note that we shall not be responsible for any costs which you have incurred in anticipation of attending the event (such as travelling costs) even if you have notified us that these costs have or will be incurred. Any costs that you incur prior to the event and in anticipation of attendance will be at your risk.

Online courses

Once online training material has been accessed no refunds will be made. Access to the unit will be ongoing for the duration of the course but is limited to the named individual only (unless a substitute has been previously agreed) and access is only permitted if payment has been received.

Our liability

We will provide the event using reasonable skill and care in a professional manner. All other warranties, conditions or other terms implied by statute or common law are excluded to the fullest extent permitted by law.

Except for death or personal injury caused by our negligence or for fraud (including fraudulent misrepresentation) and except for any other liability which cannot be limited or excluded by law, we shall not be liable to you by reason of any representation (unless fraudulent), or any implied warranty, condition or other term, or any duty at common law, for any of the following losses however these arise

a) for any loss of profit

b) loss of business or contracts

c) loss or reputation or goodwill

d) any indirect, damage, costs, expenses or other claim (whether caused by our negligence or that of our employees.

Our total aggregate liability to you for direct loss shall not exceed the amount that you pay for the event (excluding value added tax).

We shall not be liable to you for any breach of our contract with you or any delay in the event or failure to provide the event, if the delay or failure was due to a reason which was outside of our control.

To the full extent we are able by law we will not be liable to you for any direct or indirect loss which you may suffer as a result of any reliance you place upon any course material which is provided to you for or during the event. We have no liability to you for any loss of or damage to property or personal belongings which occurs during the event.

Intellectual property in the event material

The copyright in the event material is owned by HR Wallingford Ltd. You will not modify or remove any copyright notices on the event material and will reproduce any notices on any copies that you make of that material. You agree that you will only use the event material for your own personal development and not for any other purpose (and in particular you will not give the material to your colleagues or friends in any format or for any reason). You agree that you will not redistribute republish or use any part of the event material or prepare derivative works or incorporate the material in any other work for commercial use or exploitation. If you are a company or other commercial entity with a separate legal identity then you agree that the obligations in the first paragraph of this section are owed by each delegate attending the event and that you will ensure that each delegate complies with the obligations in this section.

Governing law

These terms shall be construed in accordance with English Law.
